Is the lift on gay marriage in California an issue of majority rule, minority rights?

I've heard many people criticize the california supreme court saying "OMG THIS IS AGAINST WHAT THE VOTERS WANT!

THIS IS UNDEMOCRATIC!" which it probably is.

However is it fair for a majority to determine what rights are given to a minority such as in the case of gay marriage?

Obviously there are more straight people than gays in any given state and in this country, and obviously in california there are more people who are against gay marriage than for.

However this argument is that all of this should be left up to the voting public gives the public way too much power over the lives and actions of other individuals and is not truly and not fully inclusive of everyone.

In my opinion this is one issue where the majority shouldn't be given as much power as they are usually allowed because they are dictacting the lives of individuals who if they were to participate in gay marriage would have no effect on anyone else and is there own individual life decision. Do you think there are some issues that the majority shouldn't be able to determine such as when it concerns the rights of others?

If the founding father wanted a tyranny of the majority they would have given us a true democracy instead of a representative republic.

The majority tends to win out in the end, if they are persistent enough for long enough.

But the system is set up to make it very hard for that to happen.

For example, if you want to win a decision in favor of gun rights you have to get the votes to get a conservative in office to appoint conservatives to the court so that they can get you your decision.

And then you have to make sure the court doesn't turn left and reverse that decision at some point.

But, like I said, with enough effort over a long enough period of time the majority really could do some serious damage to the rights of everyone.

The power of the majoirty must have its limits.

If the "majority" voted to allow executions of gays, should that be ok just because the "majority" say so??

If it was a simple case of majority rules, minorities and women still wouldn't be voting.

That is why the Supreme Court holds the nuts of the nation.

If the minority of the vote has a problem with the outcome of a vote they throw the issue to the court.
